The Skanner News reports on a fascinating case of mortgage fraud and elder abuse involving a Northeast Portland couple in this week’s edition.
Judith and Michael McEldery won a public apology and out-of-court settlement from Delaware-based Nationstar Mortgage Inc. after a fierce battle over a loan to update a house that had been in the family for more than 50 years.
The McElderys won an early victory over the summer when the lender’s foreclosure suit was dismissed after they were able to prove Nationstar had cashed their payment checks.
The couple, represented by attorney Michael Fuller, prevailed in a subsequent claim that Nationstar promised to modify a loan but made it essentially impossible for them to get in touch with the staff member assigned to the case.
Fuller tells The Skanner it was the first time he’s seen an apology as part of a resolution to a fraud and elder abuse case.
