Why is My Insurance Company Delaying My Claim?

Insurance companies profit by delaying claims. The pool of money an insurance company has between the time it collects premiums and pays claims is called the “float.” The longer an insurance company can delay claims, the larger the float the insurance company has to invest. The larger the float the insurance company has to invest, the bigger the profits the insurance company can make.

In 2024, a ride manufacturer’s carelessness caused 28 riders to become injured at Oaks Amusement Park. The insurance companies initially denied the families’ claims, forcing the families to go to Court. After denying all liability for two years and delaying the families’ claims, the insurance companies offered only $5,000 to settle the claims. In August 2026, Underdog Law Office represented two of the families in a jury trial against the park and manufacturer. The defense finally admitted fault the week before trial, and the jury allowed each family $275,000 compensation.

Oregon law (including ORS 746.230) protects people when insurance companies unfairly delay claims. At Underdog Law Office, our experienced contingency trial attorneys fight for people who have had claims unfairly delayed by insurance companies.

What Can You Do When an Insurance Company Delays or Denies Your Claim?

Insurance companies profit by denying claims. Customers are led to believe they are buying a “full coverage” policy, only to find out later that in the event of an accident, their claims are actually excluded by the “fine print.” Some of you older folks may remember the classic Looney Tunes cartoon called Fool Coverage, where Porky buys an insurance policy from Daffy, only to discover absurd conditions in the fine print. The cartoon was released in 1952, and insurance companies are still up to the same old dirty tricks. Insurance companies have been unfairly denying claims for over 75 years, and if it weren’t for contingency trial lawyers, insurance companies would get away with it.

In 2022, an Oregon customer noticed that his health insurance company was failing to properly credit his family’s plan deductible. The customer wrote and called the insurance company but each time he was given the run around. Underdog Law Office filed a class action lawsuit against the insurance company. As a result, the company fixed its “processing error” and gave full refunds with interest to each of its affected customers.
